These Terms govern your use of Hover CTRL (the “Service”), provided by Affiliate Mechanic, located in Burnet County, Texas, United States (“we”, “us”, “our”). By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
1. The Service
Hover CTRL is a hovering on-screen widget and admin platform that surfaces keyboard shortcuts and related productivity tools, optionally white-labeled for your brand. Features and limits depend on the plan you purchase.
2. Accounts
You must provide accurate information when creating an account and keep your credentials confidential. You are responsible for all activity under your account.
3. Acceptable Use
You agree not to misuse the Service. You will not:
- use the Service for unlawful, fraudulent, deceptive, or abusive purposes;
- send spam, malware, or content that infringes third-party rights;
- probe, scan, or test the vulnerability of any system or network without permission;
- scrape, mirror, or reverse engineer the Service except as permitted by law;
- resell or redistribute the Service except as expressly permitted by your plan.
4. Intellectual Property
We retain all right, title, and interest in and to the Service, including all software, documentation, branding, and underlying technology. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your plan. Any feedback you provide may be used by us without obligation.
5. Your Content
You retain ownership of content you submit to the Service. You grant us a limited license to host, store, and process that content solely to operate and improve the Service.
6. Payments and Billing
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, currency conversion, subscription renewal, and cancellation mechanics are governed by Paddle's Checkout & Buyer Terms. Refunds are governed by our Refund Policy.
7. Service Availability
We work hard to keep the Service running, but we do not guarantee that it will be uninterrupted, secure, or error-free. We may modify, suspend, or discontinue any part of the Service at any time.
8. Suspension and Termination
We may suspend or terminate your access if you materially breach these Terms, fail to pay, create a security or fraud risk, or repeatedly violate our policies. You may stop using the Service at any time. On termination, your license to use the Service ends; we may delete your account data after a reasonable retention period.
9. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by law, Affiliate Mechanic will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill. Our aggregate liability for any claim arising out of or related to the Service is limited to the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim. These limits do not apply to liability that cannot be excluded under applicable law.
11. Indemnification
You agree to defend and indemnify Affiliate Mechanic from claims arising out of your content, your use of the Service in violation of these Terms, or your violation of applicable law.
12. Governing Law
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict of laws rules. The exclusive venue for disputes is the state and federal courts located in Burnet County, Texas, and you consent to personal jurisdiction there.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or in the Service). Continued use after changes take effect means you accept the updated Terms.
